The lead prosecutor overseeing the case against former FBI Director James Comey, stemming from an Instagram post of seashells allegedly interpreted as a threat to President Donald Trump, has withdrawn from the prosecution. Matthew Petracca, the sole prosecutor assigned to the case from the U.S. Attorney's Office for the Eastern District of North Carolina, was replaced by assistant U.S. Attorney Timothy Severo, according to a court filing late Friday.

The Justice Department did not provide any explanation for Petracca's withdrawal from the high-profile case. The unsealing of charges against Comey occurred late last month, and his trial is currently scheduled to begin on October 21.

Comey was charged after posting a photograph on Instagram depicting seashells arranged to form the numbers 86 and 47. Prosecutors cited the slang meaning of "86" as "to nix or get rid of something," and with Trump being the 47th president, allies of the president alleged the post constituted a veiled threat. Following public backlash, Comey removed the image and stated he was unaware of any association with violence.

Comey's legal team is reportedly preparing to challenge the indictment vigorously, aiming to have the case dismissed before it reaches trial. These challenges are expected to involve various legal arguments.

Critics of the indictment suggest it represents another instance of the current administration targeting perceived opponents. This perspective gained traction after a judge previously dismissed an indictment against Comey on unrelated charges.

At the press conference announcing the charges, acting Attorney General Todd Blanche asserted that Comey's Instagram post had crossed the boundary between protected First Amendment speech and conduct that warrants prosecution.

A spokesperson for the Justice Department did not immediately respond to a request for comment regarding the prosecutor's withdrawal.
